§ 92.05 TREE BOARD.
   (A)   Establishment. The Tree Board shall be composed of seven members. Members shall be appointed by the Mayor with approval of the City Council. These members shall serve without pay and the majority shall reside within the city. Members of the Board shall consist of diverse ages and interests including: gardening, agriculture, horticulture, arboriculture, conservation, botany, biology, and the like. In addition, members should include: nursery owner, Chamber of Commerce member, elected city official, utility company official, and forester.
   (B)   Term of office. The term of the seven board members to be appointed by the Mayor shall be three years with the first time appointment being one year for one member, two years for the second member, and three years for five members. In the event that a vacancy shall occur during the term of any member, his or her successor shall be appointed for the unexpired portion of the term.
   (C)   Duties. The Tree Board shall perform the following duties:
      (1)   Within a reasonable term after the appointment of the Tree Board, upon call of the Chairperson of the Tree Board, the Tree Board shall meet and adopt rules of procedure for regular and special meetings to fulfill the duties imposed upon it by this section.
      (2)   The Tree Board shall obtain advice and consult with a forester or arborist on any matter pertaining to the City Tree Ordinance and its enforcement. The topics under which this advice and consultation may be given, may include, but not be limited to the following:
         (a)   Amendments to the City Tree Ordinance, and alterations or revisions of the Arboricultural Specifications Manual, and alterations or revisions of the Urban Forestry Plan.
         (b)   Policy concerning selection, planting, maintenance, and removal of trees, shrubs, and other plants within the city.
         (c)   Receive and review all requests for live tree removal.
         (d)   Allocations of funds for tree planting and maintenance.
         (e)   Establishment of educational and informational programs.
         (f)   Issuance of permits, which may be required by this section.
      (3)   The Tree Board, upon the request of any person who disagrees with the decision of an arborist or forester, the Arboricultural Specifications Manual, the Urban Forestry Plan, or the interpretation or enforcement of this section including disputes which arise, shall decide the outcome. The decision of the majority of the appointed members of the Tree Board with regard to such dispute shall be binding.
