6-1-10: PLATTED SETBACKS AND BUILDING LINES:
   All building and setback lines shown on plats of subdivision recorded after June 3, 1958 shall be presumed to be reflective of the Village Board's intent.
   (A)   Where a platted building or setback line is in conflict with the minimum setback provisions of the Zoning Ordinance, the more restrictive requirement shall apply.
      1.   Relief: Property owners may seek relief from a platted building or setback line in accordance with the following:
         (a)   Where a platted building or setback line is the same as the minimum setback for a subject property pursuant to the Zoning Ordinance, the property owner shall only be required to seek approval of a variance to the Zoning Ordinance and shall not be required to obtain approval of a platted setback waiver as prescribed herein.
         (b)   Where a platted building or setback line is greater than the minimum setback for a subject property pursuant to the Zoning Ordinance, the property owner shall be required to seek approval of a waiver to the subdivision regulations, which shall be processed in accordance with Chapter 3 of this Ordinance.
