7-4-7: INSURANCE, INDEMNIFICATION AND HOLD HARMLESS REQUIRED:
The village will not accept any liability for injury or damage to any person or property resulting from any activities related to a special event.
   (A)   Insurance: Any person, organization, or group requesting a special event permit shall provide a certificate of insurance and additional insured endorsements, issued by a company acceptable to the village and authorized to do business in the state of Illinois. In order to meet its obligations under this section, an applicant shall submit with its application for a special event permit, evidence of commercial liability insurance in an amount reasonably acceptable to the village, as determined by the village manager’s office, naming the village, its elected and appointed officials, attorneys, employees, contractors, and volunteers as additional insured on a primary and noncontributory basis, with limits of not less than one million dollars ($1,000,000.00) per occurrence and two million dollars ($2,000,000.00) aggregate covering any such claims, unless such requirement is reduced or waived by the village manager for good cause shown. Events occurring over multiple days or higher risk events which pose a greater likelihood of resulting bodily injury may require higher liability insurance limits.
   (B)   Indemnification And Hold Harmless Agreement: The permit application shall be accompanied by an indemnification agreement in which the applicant and/or sponsor of the special event agrees to the fullest extent permitted by law, to defend, indemnify and hold harmless the village, its officials, agents, employees and volunteers against all injuries, deaths, loss, damages, claims, suits, liabilities, judgments, cost and expenses (including attorney fees), which may in any way accrue against the village, its officials, agents, employees and volunteers arising in whole or in part or in consequence of the applicant's use of the public property, public right of way, public equipment or public personnel or volunteers at, during, or in conjunction with the special event described in the permit. The duty to indemnify and hold harmless under this section shall not apply to injuries, death, loss, damages, claims, suits, liabilities, judgments, and costs arising out of the sole legal cause of the village, its officials, agents or employees.
