7-1A-4: USE OF VILLAGE RIGHT-OF-WAY FOR EQUIPMENT AND MATERIAL:
   (A)   Prohibition Of Equipment And Materials On Village Right-Of- Way:
      1.   No equipment or materials of any private or public corporation, association, or individual shall be placed for a period of time greater than thirty (30) days, or constructed upon, under, over or along any Village right-of-way within the corporate limits of the Village without first obtaining the written consent of the Village as provided in this section.
      2.   For purposes of this section, "equipment" or "materials" includes, but is not limited to, poles, wires, cables, pipelines, gravel, machinery, trailers and any other items or matter which are placed or sought to be placed on the Village right-of-way.
   (B)   Applicability: Notwithstanding any of the foregoing, the provisions of this section shall not apply to those materials and that equipment lawfully placed upon the Village right-of-way pursuant to:
      1.   Title 11, "Telecommunications", of this Code; or
      2.   A valid permit issued by the Village for the excavation or opening of any Village right-of-way according to the provisions of section 7-1-4 of this title; or
      3.   Section 7-1A-5 of this chapter.
   (C)   Agreements In Existence: All written and executed agreements which grant permission to place equipment or materials upon, under, over or along Village rights-of-way within the corporate limits of the Village shall supersede the requirements of this section until the termination, revocation, cancellation, or other cessation of the agreement.
   (D)   Penalty: Notwithstanding and in addition to any other remedies available to the Village, any person, association or corporation acting in violation of this section shall be fined as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures” for every day of such violation.
