901.075   OBSTRUCTING VIEW OR FLOW OF TRAFFIC.
   (a)   No property owner or person in charge of any property abutting a street, alley or roadway within the Village shall permit vegetation to grow or any other matter to impair the view of individuals traveling upon the roadway or impair the flow of traffic upon the roadway.
   (b)   In all cases where the police department determines that an impairment of view or flow of traffic has occurred or that such an obstruction is a hazard to public safety a warning letter shall go to property owner by certified mail from the police department giving ten (10) days from the date of the receipt of the letter to rectify the situation by removing the obstruction.
   (c)   Failure to respond and remove the obstruction by the property owner or person in charge of the property within the time period allotted above shall constitute a miscellaneous misdemeanor with a fine of $50 a day for every day that the obstruction remains in place post the allotted time for removal.
   (d)   An imposition of the penalty described in division (c) of this section shall not preclude the Village Municipal Attorney from instituting an appropriate action or proceeding in law or inequity to restrain, correct, or abate a violation of any provision of this section or to prevent the continued violation of the same.
