1318.05   VACANT STRUCTURE MONITORING FEE.
   (a)   The Zoning Inspector will identify vacant structures as defined by this chapter.
   (b)   The vacancy "start date" shall be the date of mailing of a written notification sent certified mail by the municipality to the owner notifying the owner that the subject structure has been identified as vacant. On the forty-fifth day after the "start date", should the structure remain vacant as defined in this chapter, the owner of the structure shall be required to pay a vacant structure monitoring fee, to be established by the Council of the Village of Lisbon.
   (c)   The owner of a vacant structure shall pay an annual monitoring fee of two hundred fifty dollars ($250.00) per structure for the first 365-day period that the structure is vacant. The fee will increase to five hundred dollars ($500.00) for the second 365-day period and one thousand dollars ($1,000) per 365-day period thereafter until the structure is no longer vacant or subject to the vacant structure monitoring fee waiver as set forth in Section 1318.06. The first annual fee shall be paid on the forty-fifth day after the "start date", if the structure remains vacant as defined in this chapter, and thereafter on or before each 365-day period from that date if the structure remains vacant. If the fee is not paid, the owner shall be subject to late fees and legal action including, but not limited to, civil actions to collect late fees and any costs associated therewith.
   (d)   The fee, and any late fees, shall be paid in full prior to the issuance of any permits.
   (e)   All delinquent fees shall be paid by the owner prior to transfer of ownership interest in the vacant property. A hold may be placed on the transfer or activation of Village utilities until all delinquent fees have been paid.
   (f)   There shall be no pro-ration of the monitoring fee.
