1515.03   RECOVERY OF COSTS BY VILLAGE.
   The Fire Chief or his designated representative shall keep a record of the costs of the Village incurred through or in connection with investigating, controlling, neutralizing, abating, disposing of or cleaning up a hazardous materials incident. After completing such measures, the Chief or his designated representative shall be authorized to collect such costs in a civil action, in which the Village shall be the plaintiff and the transporter shall be the defendant. The liability of the transporter to the Village shall not be conditioned upon evidence of willfulness or negligence on the part of the transporter. All moneys received or collected under this section shall be credited to the appropriate funds of the Village from which moneys were expended in connection with the hazardous materials incident.
