§ 71.99 PENALTY.
   (A)   Penalty; appeal.
      (1)   Violation of any provision hereof constitutes a traffic violation, subject to a base fine of $15. The fine shall remain $15, if paid within 3 business days after the date and time of issue. A business day shall be defined as Monday through Friday, excluding city holidays (New Year's Day, Good Friday, Primary Election Day, Election Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving, and Christmas).
      (2)   The fine shall increase automatically to $25 if the fine is paid after the end of the third business day following the date of the citation, but before the end of the sixth business day following the date issuance of the citation.
      (3)   The fine shall increase automatically to $35 if not paid within 30 calendar days following the date of citation.
      (4)   An individual may challenge and/ or appeal the issuance of a traffic violation citation and/or automatic escalation of fine, by appearing in person before the City Clerk-Treasurer, or his or her designee, on or before the third business day following the date of the citation, between the hours of 9:00 a.m. and 12:00 p.m. in the office of the City Clerk-Treasurer located at 86 South Main Street, Linton, Indiana. The City Clerk-Treasurer shall conduct an informal hearing, which may be reconvened from time to time, and the Clerk-Treasurer shall have authority to declare the citation void or valid. If the Clerk-Treasurer declares the citation void, the citation shall be dismissed from further prosecution. If the Clerk-Treasurer declares the citation to be valid, the citation shall be due and payable as determined by the City Clerk-Treasurer. The decision of the City Clerk-Treasurer shall be final, subject to judicial determination upon prosecution.
      (5)   An individual may challenge the parking violation citation, provided that he or she is the owner of the vehicle and/or was responsible for the vehicle at the time of issuance of the citation. An individual may challenge in person or be representation of his or her attorney.
   (B)   Parking citation.
      (1)   The City Clerk-Treasurer shall promulgate a parking citation form. The form of the citation shall set forth the date and time the citation was issued; the vehicle and license plate number to which the citation was issued; the amount of fine; the time for payment of fine and for escalation of fine; and the business address and hours of the City Clerk-Treasurer.
      (2)   The Linton City Police, or other traffic enforcement officer as may be designated by the City Council, is authorized to notify persons violating any provision of § 71.01, by affixing to the violating vehicle a traffic citation in the form of and containing the information set forth in § 71.01 hereof.
      (3)   The police or other parking enforcement officer shall maintain a separate report of citations issued. The separate report shall contain the date and time the citation was issued; the make and license number of the offending vehicle; and the location where parked. The police or other parking enforcement officer shall provide the separate reports to the City Clerk-Treasurer on a daily basis.
