§ 93.22 BOND REQUIRED.
   (A)   Before any permit shall be issued to any person desiring to perform any of the work contemplated in § 93.20, he or she shall file with the city's Clerk-Treasurer an appropriate bond in the amount as the Superintendent shall determine, but in no case shall the amount of the bond be less than $500. The bond shall provide that he or she will faithfully perform and do the work in a manner satisfactory to the city's Superintendent. The bond shall further indemnify the city against any damages resulting to third persons as a result of any negligence or improper work done by the person. In the event the work is to be performed by any plumber, contractor or other person, he or she shall file a bond with the city's Clerk-Treasurer in accordance with the provisions of this section prior to the commencement of any work.
   (B)   The bond required by this section shall be kept in force by the permittee for a period of at least one year after the completion of the work and shall not be released by the city's Clerk-Treasurer until the permittee has settled all claims, either on behalf of the city or by other persons, resulting from the work.
   (C)   If an excavation project is of sufficient scope to warrant the filing of a surety bond in excess of $500 or if the applicant makes frequent excavations annually, the Superintendent may require the applicant to file a surety bond in the amount of $10,000; and
   (D)   The Superintendent may, when in his or her judgment the action is in the best interests of the city, waive a bonding requirement for a single excavation of a minor nature when the work is to be done by a reputable and reliable contractor.
