(A)
The penalty for violation of this chapter may be levied at the amount of $50. Each day the Amish cabin, mobile home, tiny home/tiny house, converted camper or mobile home community is in violation is a separate violation, and the violating owner will be penalized at a cost of $50 per day per violation.
(B) The placement or occupancy of any Amish cabin, mobile home or tiny home/tiny house in violation of this chapter is hereby declared to be a nuisance, and therefore subject to applicable nuisance laws. In addition to any other relief provided by this chapter, the City Attorney may apply to a court of competent jurisdiction for an injunction to prohibit the continuation of any violation of this chapter. The application for relief may include seeking a temporary injunction and permanent injunction.
(C) Legal fees for prosecution of violations of this chapter will be assessed against the violator in the amount of $125 per day. Additional fees and costs will be levied against the violator in amounts established by the law of the State of Indiana in a court of competent jurisdiction.
