§ 96.01 FAIRVIEW CEMETERY; NEW RATES.
   (A)   The Linton Cemetery Board has the power and duties to establish the price for and to sell the cemetery plots to individuals upon the terms and conditions set out by the Board.
   (B)   The following rates and rules will supersede all current rates and rules for Fairview Cemetery.
      (1)   Rates:
Grave space in the section commonly known as "Fence Section," which is more specifically described as the northeast corner of Section 5 of the cemetery map plotted thereof
(Note: The section named here has very few spaces suitable for burial due to low-lying areas; it does not dry out.)

      (2)   No burials on Sundays or (select) federal holidays, which include: New Year's, Easter, Memorial Day, Independence Day, Thanksgiving, and Christmas.
      (3)   No burials after 4:00 p.m. All parties will have to be in and out by 4:00 p.m. or a charge of $100 will be assessed.
      (4)   There is a one-hour time limit for funerals from the time the hearse arrives. City personnel will return to work after a one-hour interval.
      (5)   New rates are effective immediately upon passage of this section.
      (6)   All funeral homes, monument companies, and commercial interests must contact Fairview Cemetery with a minimum of 24 hours' advance notice prior to entering the cemetery for the conduct of business.
      (7)   The cemetery is not responsible for poorly constructed foundations or inadequate workmanship of monument companies.
      (8)   The cemetery is not responsible for maintenance of gravestones/monuments or foundation replacement involving an "act of God" or nature, such as excessive rain, flooding, etc. (The cemetery cannot absorb the total cost of replacement. Accidents, such as damage done with vehicles or equipment, are not included in this situation.)
      (9)   The cemetery is not responsible for theft or vandalism of personal items placed at gravesites. (See "Decorations" section of Addendum A.)
      (10)   The attached Addendum “A,” “RULES AND REGULATIONS OF THE FAIRVIEW CEMETERY BOARD GOVERNING THE OPERATIONS OF FAIRVIEW CEMETERY, LINTON, INDIANA 47441” are adopted herewith as a part of Ordinance 2017-02 and constitute those rules and regulations under which cemetery operations are to be conducted.

RULES AND REGULATIONS OF THE
FAIRVIEW CEMETERY BOARD
GOVERNING THE OPERATIONS OF
FAIRVIEW CEMETERY
LINTON, INDIANA 47441
INTRODUCTION
   These grounds are the resting place of our beloved. Here they rest from their labors. The burdened and the carefree will be at ease together. The small and the great will be here alike. In undisturbed silence, Earth will receive that which is mortal and perishable, the dust returning unto the dust. Sustained by our confidence in holy wisdom and goodness, may we learn to face death in this place of immortality as a house of life.
   As we see and dedicate the visible memorials at the grave of our loved ones, may we recognize that it is but a symbol of our enduring reverence and affection.
   That our solemn thoughts may help us to keep these grounds sacred to their memory, these rules and regulations have been published.
   I.   RULES TO BE OBSERVED BY GRAVE OWNERS.
      1.   LOT WORKERS - The holder of the rights to burial on each lot may contract a monument company to erect at his/her expense, suitable landmarks to be set within the headstone perimeter (see IV).
      2.   TREES, SHRUBS, ETC. - The planting of trees, shrubs, and flowers are not permitted. As current trees, shrubs and flowers die, they will not be replaced unless authorized by the cemetery superintendent.
      3.   LOTS - Lots/cemetery spaces shall not be used for any other purpose than a place of burial for the dead; and no trees within the lots or borders shall be cut down or destroyed without the consent of the cemetery superintendent.
      4.   BURIALS - No burials will take place on Sunday.
      5.   FENCES - Private fences, enclosures, curbs, or edgings around lots will not be allowed.
      6.   VEHICLES - Vehicles will at no time be allowed off the roadways.
      7.   INTERMENTS - Proprietors shall not allow interments to be made in their lots for remuneration. All interments and lots shall be restricted to the members of the family and relatives of the proprietor thereof, except special permission to the contrary and obtained in writing from the cemetery superintendent.
         No interments are allowed until payment for the lot is provided for according to the regulations.
      8.   LOT IMPROVEMENTS - Proprietors wishing improvements upon their lots must pay for the same to the cemetery superintendent, when ordered.
         The grading of all lots must be under the direction of the cemetery superintendent.
   II.   INTERMENT.
      1.   GRAVE OPENING - All holders of burial permits requesting graves opened should hand permit to the funeral director who will order the grave opened by the cemetery board of its representative.
         All orders for opening graves must be made at least twenty-four (24) hours before time set for the funeral.
   III.   REMOVALS.
      1.   Removals will be made only upon presentation of a state removal permit. The charge will be made according to the estimated time and labor involved. Any repairs to lot necessitated by removal will be made at the expense of the holder of the burial removal permits (sodding, seeding, filling, etc.)
      Only cemetery employees will be allowed to be present at the removal of a body. Under no conditions will family or curiosity seekers be allowed in the vicinity at this time.
   IV.   MARKERS, MONUMENTS, FOUNDATIONS. CURBING AND FENCING.
      1.   FOUNDATIONS - Foundations for markers/monuments will be poured with 3,000 lb. concrete. The minimum depth of a foundation must be 24" and should be increased in depth by an amount equal to the number of inches that the monument exceeds 24" in height. The soil is to be properly compacted and the foundation is to be formed at the top at grade level. The concrete is to have a trowel finish and edged with a minimum 2" border around the monument.
      2.   FOOTERS - All footers must be level, flush with the finished ground level, of finished concrete, extending 4" in all directions from the stone, not over 4' wide and not over 18" long.
         a.   Lights, shepherds hooks/pot hangers shall not be placed in the foundation of the headstones. (These items may cause permanent damage to the foundation of the headstone, of which the cemetery cannot assume responsibility.)
      3.   MARKERS/MONUMENTS - Markers/monuments are to be located so that the west edge of the foundation lies against the west edge of the boundary of the lot.
      4.   FOUNDATIONS - All foundations of monuments and other structures shall be made satisfactory to the cemetery superintendent, and no such foundations shall be put in until approved by the cemetery superintendent.
      5.   HEADSTONES/NO FOOT MARKERS - Headstones are allowed only at the "head" or west edge of the grave space. No foot markers or other markers shall be placed at the foot or middle of the graves. (Military markers can be placed on the back of the stone or used as the headstone.)
      6.   GRAVES - All graves will be flat to the earth.
      7.   STONE LOCATIONS - Stone locations must be approved by the cemetery superintendent before setting the stone. After October 1, 1980, monument companies will pay a fee, to be determined by the Cemetery Board, for each grave for locating headstone site. This fee is to be paid to the cemetery superintendent who in turn will deposit this money with the Clerk-Treasurer of the City of Linton, and this money will be credited to the Cemetery Fund.
       8.   MONUMENT/EFFIGY - If any monument, effigy, or any structure whatever, or any inscription be placed in or upon any lot which shall be determined by the majority of the Cemetery Board to be offensive, improper, or injurious to the appearance of the surrounding lots or grounds, the Cemetery Board shall have the right and shall be their duty to enter upon such lot and remove the said offensive or improper object or objects.
      9.   CURBING, FENCING, ETC - Curbing, fencing, edging, etc., are not permitted. As current curbs, metal fences, etc., become broken and/or deteriorated, they will be removed. No curbs, fences, edging, or trellises will be permitted in the future. At the discretion of the Cemetery Board, holders of burial lot deeds or their descendants may be asked to remove curbs and/or fencing, etc.
   V.   DECORATIONS.
      1.   FLOWERS - Flowers will be permitted in vases and urns the year round, providing the vases and urns are properly attached to the marker or monument.
      2.   FUNERAL FLOWERS - Floral designs or other decorations will be removed from lots or graves as soon as the flowers become wilted or unsightly, and persons wishing to retain the same must remove them within 48 hours after the funeral.
      3.   WINTER DECORATIONS - Winter decorations, holly, evergreen, or artificial wreaths may be placed on graves beginning November 1 and may remain until March 1, after which date all decorations will be removed. If these are to be kept for future use, they must be removed and cared for by the holder of the burial permit before March 1.
      4.    MEMORIAL DAY FLOWERS - Flowers may be put on the grave in the following manner:

         a.   Flowers will not be placed on the grave earlier than the Saturday before the legal Memorial Day and must be removed before June 1.
         b.   No glass containers shall be used at any time.
      5.   POT HANGERS/SHEPHERDS' HOOKS - Pot hangers or shepherds' hooks may be used at the base of the headstones only, in the line with monuments at the west edge of the lot. The cemetery is not responsible for damage to pot hangers. (Use at your own discretion.)
   VI.   GENERAL RULES.
      1.   There will be no admittance to the cemetery between sunset and sunrise.
      2.   Vehicles will at no time be allowed off of the roads.
      3.   Until January 1, 1981, the right to burial grave prices in the Ed Greenwood Addition to the Fairview Cemetery will be determined by the City Council, at the request of the Cemetery Board.
      4.   All workmen employed in the construction of vaults, erection of monuments, landmarks or any other work, must be subject to the control and direction of the cemetery superintendent; and any workmen failing to conform to this regulation will not be permitted to afterwards work on the grounds.
      5.   All graves must have a vault that will support the weight of the earth. No green burials.
   It is the objective of the Cemetery Board of Directors of the Fairview Cemetery to maintain the cemetery in the best way possible within the financial capabilities of the Board. Flowers, shrubs, curbing, etc. make the job of mowing the cemetery very difficult if not impossible. For those who have loved ones interred in the Fairview Cemetery, it is our desire that they try to understand that the rules and regulations are for the benefit of all.
