(A) Establishment. A farmers' market is hereby established to operate in Humphrey's Park from April through October of each calendar year.
(B) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
FARMERS' MARKET. A place in Humphrey's Park where vendors will be able to sell produce in a space designated by the Park Board.
FEE. The price required to be paid for the use of the Humphrey's Park farmers' market to offset the costs of maintaining and establishing the market.
FINES. Costs that are to be assessed to any vendor that leaves the farmers' market or Humphrey's Park in an unsafe, unclean, or spoiled condition.
SEASONAL PASS. A permit that can be purchased for the use of the Humphrey's Park farmers' market for a period from April through October of that calendar year in which it is purchased.
SINGLE DAY PASS. A permit that can be purchased for a one time use of the Humphrey's Park farmers' market from April through October of that calendar year in which it is purchased.
VENDOR. A person or entity who wishes to sell produce in Humphrey's Park consistent with the rules promulgated by the Park Board and the Common Council.
(C) Authority. The Park Board is given the authority to establish rules, administer, and supervise the farmers' market to promote the health, safety, and welfare of the citizens.
(D) Fees. The fees for weekly (Monday through Friday) produce vendors who wish to sell at the farmers' market will be:
(1) $10 for a single day pass;
(2) $150 for a seasonal pass; and
(3) $5 for an application processing fee.
(E) Penalty.
(1) Vendors that cause conditions subjecting them to fines shall be charged as follows:
(a) $25 for leaving trash, unsold produce, or waste products; and
(b) $50 for creating a condition that is unsafe and dangerous.
(2) Any vendor receiving a fine that is not paid for a period of five days or more will be barred from selling in the Humphrey's Park farmers' market for a period not less than one year.
