§ 95.37 REGULATION OF WATER SPORTS.
   (A)   This chapter shall regulate water sports activities on Sunset Lake owned by the City of Linton, Indiana, and shall apply only to that body of water.
   (B)   It shall be illegal for any person to swim in Sunset Lake.
   (C)   It shall be illegal for any person to scuba dive in Sunset Lake without first having obtained a permit to do so issued by the City of Linton.
   (D)   The Clerk-Treasurer of the City of Linton or his or her assignee shall issue to any person over the age of 18 years who has paid the prescribed permit fee, signed a general waiver of liability, and is currently a certified diver, a permit to scuba dive on Sunset Lake.
   (E)   The fee for obtaining a permit to scuba dive on Sunset Lake shall be $15 for a one-year permit, $5 for a one-week permit and $3 for a one-day permit which shall be paid to the Clerk-Treasurer of the City of Linton and the funds collected therefrom shall be deposited in the General Fund of the City of Linton.
   (F)   Permits for scuba diving shall be valid for the period indicated on the face of the permit.
   (G)   Any person under 18 years of age may not scuba dive in Sunset Lake unless they are accompanied by a parent or guardian who has a current permit issued by the City of Linton to scuba dive and the parent or guardian has signed a waiver of liability on behalf of the child with the City of Linton.
   (H)   Any person who violates any of the provisions of this section shall be fined in the sum of $25.
