(A) The Phil Harris Golf Course Committee has amended the private golf cart owners policy, effective April 12, 2004 and retroactive to March 1, 2004.
(B) This policy addresses the privilege of private golf cart ownership on the Phil Harris Golf Course and the use of private golf carts.
(C) The policy reads as follows:
(1) There shall be no new private golf carts or private golf cart privileges allowed on the Phil Harris Golf Course.
(2) The select owners of private golf carts, who have the privilege of private golf cart use on the Phil Harris Golf Course, shall pay the following fees for the year of 2004. Each private golf cart owner shall pay a rolling fee of $100 per year, plus the appropriate surcharges each time a round of golf is played. This includes each person in the private golf cart.
(3) Each private golf cart owner, who has the privilege of private golf cart use on the Phil Harris Golf Course, shall abide by all rules of regulating body of the Phil Harris Golf Course.
(4) Each private golf cart owner, who has the privilege of storing his or her golf cart in the maintenance barn, shall pay rent to the Phil Harris Golf Course of $150 for 2004, effective April as, 2004 and retroactive for the 2004 golf season.
(5) Each private golf cart owner, who has the privilege of private golf cart use on the Phil Harris Golf Course, is required to provide proof of insurance to the Phil Harris Golf Course and the City of Linton, listing the Phil Harris Golf Course and the City of Linton as the insured and provide a copy of the proof of insurance to the Golf Pro on or before May 15, 2004. All private golf cart owners shall sign a waiver that will exclude the Phil Harris Golf Course and the City of Linton, and golf course personnel from any liability resulting from the use of private golf carts.
(6) All private golf cart owners must hold a season pass to the Phil Harris Golf Course. If a season pass is not purchased, that owner shall give up all rights to private golf cart privileges and will be required to remove his or her private golf cart.
(7) All private golf cart owners shall have all fees paid by May 15 of each year.
(8) If any of the above policies are not complied with by the private golf cart owners all private golf cart privileges shall be forfeited by that private golf cart owner and removal of that golf cart shall take place no later than five days after being informed of any infractions by the golf pro.
(9) There shall be no extensions of fees beyond May 15, 2004.
(D) This section shall be in full force and effect from the date of its passage and approval by the Mayor and the Common Council of the City of Linton, Indiana.
