Notwithstanding any other provision of this section, burning shall be permitted within the City of Linton if the burning is in an incinerator approved by the state pursuant to a permit issued by a state agency as authorized by law pursuant to I.C. 13-20-8. Any other burning must be by permit issued from the City of Linton Fire Department. All persons who wish to open burn must contact the Linton Fire Department not less than 24 hours before the burn is to take place. If no permit is issued, and the burn occurs, it is an automatic violation of this section.
