§ 91.02 OPEN BURNING RESTRICTED; GENERAL PROHIBITIONS.
   (A)   It shall be unlawful at all times to cause or allow any open burning at any place within the City of Linton except as permitted herein; provided, no person shall cause, allow or permit the emission into the atmosphere of any substance or combination of substances from the burning of any product that causes annoyance or constitutes a nuisance so as to interfere with the health or well-being of any individual in his or her home or place of employment or recreation or as to interfere with the normal use and enjoyment of any such place. The burning of garbage is expressly prohibited.
   (B)   No burning shall be conducted during unfavorable meteorological conditions such as humid days, ozone warning times/days, temperature inversions, high winds, drought conditions, air stagnation, or when any governmental entity determines or issues a warning or prohibition against burning due to weather or potential dangers.
   (C)   At no time will any person burn the following:
      (1)   Tires;
      (2)   Unclean petroleum products (such as used oil, tar, grease, or petrol);
      (3)   Asbestos (such as vinyl siding, asphalt, roofing shingles, insulation, plastics, coated wiring, and floor tile);
      (4)   Treated, varnished, painted, or glued wood products;
      (5)   Household or business refuse or garbage;
      (6)   Railroad ties;
      (7)   Chemicals; and/or
      (8)   Paint in any form (such as cans, demolished buildings with painted materials, fencing that has been treated or painted, cans of unused paint, empty paint cans).
   (D)   No person or business shall kindle or maintain any open burning consisting of refuse, trash, or garbage fire, leaf fire, bonfire, or other open burning. No burning of any kind, except small charcoal grills, may be conducted at any time in mobile home parks, apartment complexes, condominium complexes, or buildings of more than four dwellings pursuant to the laws of the State of Indiana.
   (E)   All burning of any type must be done in a noncombustible and ventilated container, such as a steel or metal drum, with enclosed sides and bottom. Burning on the ground is illegal in the State of Indiana.
   (F)   No one will burn any item directly on asphalt pavement.
   (G)   No burning will be done within 1,000 feet of any school, nursery, daycare facility, playground, or park, or any place where the health and safety of adults and children would be jeopardized.
   (H)   No open burning will be permitted in a densely wooded area.
