§ 806.02 PENALTIES.
   (1)   Petty misdemeanors. Except as provided by division (2), any person convicted of violating any provision of Chapters 801 through 805 is guilty of a petty misdemeanor.
   (2)   Misdemeanor. Violations of any provision of Chapters 804 and 805 is a misdemeanor. A violation of Chapters 801 through 805 which is committed in a manner or under circumstances so as to endanger or be likely to endanger any person or property is a misdemeanor. Exclusive of violations relating to the standing or parking of an unattended vehicle, a violation of Chapters 801 through 805 when preceded by two or more petty misdemeanor convictions within the immediate preceding 12 months is a misdemeanor.
