§ 603.04 ISSUANCE OF CERTIFICATE.
   (1)   General. The Council shall issue a certificate only if the conditions and requirements of divisions (2), (3) and (4) are met. Each certificate shall state the name and address of the applicant, the number of vehicles authorized and the date of issuance.
   (2)   Public convenience.
      (a)   No certificate shall be issued unless the Council finds that the public convenience and necessity require additional taxicab service in the city, and that the applicant is fit, willing and able to perform the public transportation in conformance with this chapter. The Council shall take into consideration the number of taxicabs already in operation, whether or not existing transportation is adequate to meet the public need, the probable effect of increased service on local traffic conditions, and the character, experience and responsibility of the applicant. The Council shall deem it convenient and necessary to have one taxicab for each 8,000 persons living in the city, or any other number as the Council may determine by resolution. The Council may, in its discretion, permit the use of 50% additional taxicabs during the period from November 15 to April 15 of each year.
      (b)   As additional certificates may become available, they may be issued to any applicant fit, willing and able to perform under this chapter. If no other applicant is available, the holder of any outstanding certificate may be required by the Council to license and operate an additional taxicab or taxicabs or forfeit his or her existing certificate.
   (3)   Insurance. No certificate shall be issued or continued unless there is in full force and effect a liability insurance policy issued by an insurance company licensed to do business in the state for each vehicle in the minimum amount of $100,000 for bodily injury to any one person and $300,000 for each accident; and $100,000 for property damage resulting from one accident. The policy or certificate of the insurer showing issuance of the policy shall be filed in the office of the City Clerk and shall contain a provision that the insurer shall not cancel the policy without notifying the city, in writing, of the cancellation, at least ten days before the proposed cancellation date.
   (4)   Taxicab license. No certificate shall be issued or continued in operation unless a taxicab license has been issued, pursuant to § 603.06, for each taxicab to be operated.
