§ 401.37 LAWN SPRINKLER/IRRIGATION SYSTEMS.
   All lawn sprinkler/irrigation systems connected to the municipal water system, shall require a permit for connection and are to be installed in accordance with the State of Minnesota Plumbing Code (Chapter 4715).
   (1)   Purpose. The purpose of this section is to promote efficient use of water for lawn sprinkler/irrigation systems to allow the city's water system flexibility in meeting peak demands.
   (2)   Definitions. For the purpose of this section, the following terms shall have the meanings given to them.
      BACKFLOW PREVENTER. Any approved mechanical or air gap system designed and installed in order to prevent the accidental backflow of water from one source to another.
      LAWN SPRINKLER/IRRIGATION SYSTEM. All pumps, lines and sprinkler heads which are located on private property or within adjacent public right-of-way that have a sole purpose of irrigating gardens, grass or landscaping.
   (3)   Construction of a lawn sprinkler/irrigation system. The location of lines and sprinkler heads for a lawn and landscape irrigation system may be located within private property or the city right-of-way or easement subject to the following conditions:
      (a)   A permit will be required for all lawn sprinkler/irrigations systems installed. The permit cost will be established yearly in the annually adopted city fee schedule.
      (b)   The connection to the water system must be done in conformance with the Minnesota State Plumbing Code.
      (c)   The low voltage electrical wiring portion of the lawn sprinkler/irrigation system must be performed by a licensed Technology Systems Contractor who employs a qualified Power Limited Technician per M.S. § 326.242, as it may be amended from time to time.
      (d)   An approved back flow prevention device must be installed as a part of all lawn sprinkler/irrigation systems. The device shall be installed per manufacturer installation instructions. The type of approved backflow device must be provided when applying for a permit.
      (e)   All newly installed lawn sprinkler/irrigation systems are required to have rain sensors installed as part of the system. This is in accordance with M.S. § 103G.298, as it may be amended form time to time, and federal water conservation standards.
      (f)   The owner of the lawn sprinkler/irrigation system is responsible for any maintenance or repair of the lawn and landscape irrigation system.
      (g)   The owner of the lawn sprinkler/irrigation system assumes all liability and responsibility for damages to the lawn and landscape irrigation system that is caused by city activities, including but not limited to, snow removal.
