§ 51.56  DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ACTIVE METER.  Any city owned and installed meter which is currently considered in service and not a secured meter.
   COMMERCIAL USER.  Any user of the city’s water system whose lot, parcel of real estate, or building is primarily used for business or commercial purposes.
   LANDLORD.  A property owner who does not occupy a premises.
   NEW SERVICE.  The establishment of water service to any lot, parcel of real estate, or building within the city’s water system by either reestablishing existing service or establishing service by connection to the water system and the installation of a water metering unit.
   OPERATION AND MAINTENANCE.  All expenditures during the useful life of the system for materials, labor, utilities, and other items of a regularly recurring ordinary nature which are necessary for managing and maintaining the system to achieve the capacity and performance for which system was designed and constructed. The term OPERATION AND MAINTENANCE includes replacement.
   REPLACEMENT.  Expenditures for obtaining and installing equipment, accessories, or appurtenances of an infrequent major nature which are necessary during the useful life of the system to maintain the capacity and performance for which such works were designed and constructed. The term “operation and maintenance” includes REPLACEMENT.
   RESIDENTIAL USER.  Any user of the city’s water system whose lot, parcel of real estate, or building is primarily used for domestic dwelling purposes.
   SECURED METER.  Any city owned and installed meter which has been taken out of service by the city either by removal or having the service line stop valve closed, thereby denying water supply to the service line.
   SHALL.  The act referred to is mandatory.
   USEFUL LIFE.  The estimated period during which the system remains economically operable.
   USER CHARGE.  The portion of the total water service charge which is levied in a proportional and adequate manner necessary to defray the cost of operation, maintenance, debt retirement of bonded capital, and replacement of the water system.
   WATER METER.  A water volume measuring and recording device, and pressure reducing device furnished and/or installed by the city.
   WATER SYSTEM.  Any devices and systems for the storage, treatment, recycling, transmission, and distribution of water. These include transmission and distribution lines, individual systems, pumping, power, and other equipment and their appurtenances; extensions, improvements, remodeling, additions, and alterations thereof; elements essential to provide a reliable water supply such as standby treatment units and any works, including site acquisition of land that will be part of the treatment process.
