(A) Prosecuting Attorney.
(1) The Mayor, with the consent and approval of the majority of the members of the Board of Aldermen, shall appoint the Prosecuting Attorney, who shall be licensed in the State of Missouri.
(2) The Prosecuting Attorney need not be a resident of the city.
(3) It shall be the duty of the Prosecuting Attorney to prosecute the violations of the city ordinances before the Municipal Judge.
(4) The salary of the Prosecuting Attorney shall be approved by the Board of Aldermen and shall be paid by the city.
(B) City Attorney.
(1) The Mayor, with the consent and approval of the majority of the members of the Board of Aldermen, shall appoint the City Attorney, who shall be licensed in the State of Missouri.
(2) The City Attorney need not be a resident of the city.
(3) The City Attorney shall attend all regular and closed session meetings of the Board of Aldermen and shall be the legal advisor to the Board of Aldermen on all matters affecting the best interests of the city.
(4) The City Attorney shall be available from time to time to answer any questions arising from day-to-day city operations and to guide city officials as necessary in legalities.
(5) The City Attorney shall act as Parliamentarian for meeting of the Board of Aldermen.
(6) The salary or fees of the City Attorney and the necessary expenses incurred in defense of litigation or other city business affairs shall be approved by the Board of Aldermen and shall be paid by the municipality.
(C) Dual functions.
(1) The positions of Prosecuting Attorney and City Attorney may be held by the same person.
(2) In such case, the salaries or fees of each position may be combined, approved by the Board of Aldermen, and shall be paid by the municipality.
(D) Employment of special counsel. The Mayor, with the consent and approval of the majority of the members of the Board of Aldermen, shall have the authority to employ special counsel to represent the city, either in case of vacancy in the office of the City Attorney, or to assist the City Attorney, and to pay reasonable compensation thereof.
