Any person may carry out a public display of fireworks within the city upon complying with the following conditions.
(A) Application for permit. Application for a fireworks permit shall be made to the City Clerk not less than ten days prior to the proposed date of such public display, stating on such application the name of the person or organization sponsoring the display; the time, place, and date for such display, the type of fireworks to be exhibited and the name of the individuals who will be in charge of the firing of the display.
(B) Indemnity agreement. An indemnity agreement must be executed by the person applying for the permit by which the city is to be indemnified and held harmless from and against any claims, losses, suits, or demands against the city arising out of or connected with such exhibition.
(C) Issuance of permit. The application shall be reviewed by the Mayor and may be denied, issued upon certain conditions, or issued without conditions as in the judgment of the Mayor will best protect the safety and well being of the public.
(D) Appeals. If a permit is denied or issued with conditions by the Mayor, the applicants may appeal such decision to the Board of Aldermen, who may reverse the decision of the Mayor upon a three-fourths majority vote. The decision of the Board of Aldermen shall be final.
(E) Display of permit. The permit shall be prominently displayed at the site of any display.
