Every licensee or his servant or employee who sells, gives or delivers alcoholic liquor or malt beverages to an obviously intoxicated person or any incompetent person or permits any person under the age of twenty one (21) years to enter or remain in the licensed room or rooms where intoxicating liquor or malt beverages are dispensed is guilty of a misdemeanor.
