§ 72.02 PERMITTED USES.
   Except as herein specifically permitted and authorized, it is unlawful for any person to operate a snowmobile or ATV not licensed as a motor vehicle within the limits of the city.
   (A)   On the portion of any right-of-way of any public highway, street, road, trail or alley used for motor vehicle travel, except that a snowmobile or ATV may operate upon the most right-hand lane of a municipal street or alley and may, in passing or making a left turn, operate on other lanes which are used for vehicle traffic in the same direction, for purposes of going to or returning from a non-highway area of permissible operation, by the most direct route. (Snowmobiles may also be operated upon the ditch bottom or the outside bank of trunk, county state-aid and county highways, where the highways are so configured within the corporate limits.) Snowmobiles and ATV’s shall only be allowed to travel on city streets during the winter season beginning November 1 through March 31 of each year;
   (B)   On a public sidewalk provided for pedestrian travel;
   (C)   On boulevards within any public right-of-way;
   (D)   On a trail not specified for snowmobiles or ATV use;
   (E)   On private property of another without specific permission of the owner or person in control of the property;
   (F)   On any other public place, except as may be specifically permitted by other provisions of the city;
   (G)   At a speed in excess of 20 miles per hour;
   (H)   In a manner so as to create loud, unnecessary or unusual noise so as to disturb or interfere with the peace and quiet of another person(s);
   (I)   In a careless, reckless or negligent manner so as to endanger, or be likely to endanger, the safety of any person or property of any other person;
   (J)   At any place while under the influence of alcohol or drugs as defined in M.S. § 169.121, as it may be amended from time to time;
   (K)   Nothing in this chapter shall prohibit the agricultural use of an all-terrain vehicle in the rights-of-way, as defined in M.S. § 84.92, as it may be amended from time to time, relating to the use of an all-terrain vehicle to maintain permitted accesses over public road right-of-way;
   (L)   Nothing in this chapter is intended to prohibit the crossing of a city or county right-of-way, which is otherwise allowed by M.S. §§ 84.87 and 84.928, as they may be amended from time to time; and
   (M)   Nothing in this chapter is intended to prohibit the operation of a snowmobile upon the shoulder inside bank, or slope of any public highway, street, road, trail or alley as permitted by M.S. § 84.87, Subd. 3, as it may be amended from time to time.
