§ 97.02 ESTABLISHMENT.
   (A)   A cemetery has been established and is continued upon land owned by the city, and described as Fairview Cemetery. The plat of the cemetery filed with the County Recorder is adopted as the official plat of the cemetery. No person shall lay out or establish any cemetery, or use any lot of land within this city for the burial of dead, except in Fairview Cemetery or some other tract of land duly designated as a cemetery.
   (B)   Fairview Cemetery is under the direct supervision of the Mayor and the City Council. It is the aim of the city to make the Fairview Cemetery a quiet and beautiful cemetery. To continue improvement and to preserve the appearance of the cemetery requires the cooperation of all lot owners and/or licensees.
   (C)   For the mutual protection of every lot purchaser and/or licensee, the city hereby adopts the following rules and regulations. All lot owners/licensees and the use of all cemetery lots shall be subject to the rules and regulations, amendments or alterations as shall be adopted by the city from time to time; and the reference to these rules and regulations in the cemetery license agreement shall have the same force and effect as if set in full therein.
   (D)   License fees shall be set at such rates as the City Council shall from time to time designate. The City Council may review charges made for grave openings and winter and summer interment. If it is deemed advisable, the Council may adjust prices accordingly.
