§ 90.23 TREES AND OTHER VEGETATIVE PLANTINGS IN CITY RIGHTS-OF-WAY AND EASEMENT AREAS.
   (A)   Planting trees or other vegetation in the boulevard (street right-of-way) is not allowed without a permit from the city. Trees and other vegetation planted within city rights-of-way shall be maintained by the city.
   (B)   The city may plant or maintain trees and other vegetation in city rights-of-way and may assess the abutting property for any benefit or costs associated with the planting, maintenance or removal of the tree or other vegetation, whether planted by the city or the property owner.
   (C)   Trees and other vegetation may be planted and maintained in drainage and utility easements without a permit from the city at the risk of the property owner and provided that the trees or vegetation do not interfere with access to or use of the easement.
