§ 115.05 CONDITIONS OF LICENSE.
   (A)   A licensee must be of good moral character and free from communicable disease.
   (B)   A licensee must not engage in the practice of tattooing at a place other than that described in the application and license.
   (C)   A person having a skin infection, disease of the skin, or a communicable disease must not be tattooed.
   (D)   A licensee must not tattoo a person under the age of 18 except in the presence and with the written consent of that person's parent or legal guardian.
   (E)   A place used for the practice of tattooing must not be used or occupied for living or sleeping quarters, or for a purpose other that tattooing.
   (F)   The place where tattooing is conducted must have at least 150 square feet of floor space and must be lighted and ventilated to comply with standards approved by the health authority.
   (G)   Every place where tattooing is practiced must be equipped with conveniently located and approved sewer and water-connected toilet and lavatory facilities. These facilities must be maintained in good working order at all times, must be kept free from flies, insects and offensive odors, and must be kept in a clean and sanitary condition.
      (1)   Toilet fixtures and seats must be of a sanitary open front design and readily cleanable. All toilet rooms must have self-closing doors. Easily cleanable, covered receptacles must be provided for waste materials.
      (2)   The lavatory must be supplied with hot and cold running water under pressure tempered by means of a mixing valve or combination faucet. All self-closing, slow-closing or metered fixtures must be designed to provide a flow of water for at least 15 seconds. Every lavatory facility must be provided with an adequate supply of hand cleansing compound and single service sanitary towels or hand-drying devices.
   (H)   A licensee must provide to its customers a sufficient number of individually pre-packaged, pre-sterilized and disposable towels. These towels must be kept in a closed dustproof container. A towel must be used on no more than one customer and must be discarded in a safe and sanitary manner after its first use.
   (I)   Tables, chairs and operating furniture must be constructed of stainless steel and must be kept in a clean and sanitary condition.
   (J)   The equipment, including needles, stencils, razors and razor blades, must be kept in a dustproof glass case when not in use.
   (K)   Needles and operating instruments must be individually pre-packaged, pre-sterilized and disposable. Each piece of this equipment must be used on no more than one customer, and must be discarded in a safe and sanitary manner after its first use.
   (L)   Sterilizing solutions may be used for the purpose of sterilizing instruments other than needles when sterilizing solutions are approved by the health authority.
   (M)   Bandages and surgical dressings used in connection with the tattooing of a person must be individually pre-packaged, pre-sterilized and disposable.
   (N)   A licensee must wear clean, light-colored washable outer garments when engaged in the practice of tattooing.
   (O)   A licensee must wash his or her hands thoroughly with soap and water and then dry them with a clean towel before and after each tattooing. The customer's skin must also be thoroughly cleansed with soap and water and disinfected by an antiseptic solution approved by the health authority before the use or application of a tattooing instrument or equipment.
   (P)   Pigments used in tattooing must be sterile and free from bacterial and noxious agents and substances. The pigments used from stock solutions for each customer must be placed in a single-service receptacle, and the receptacle and remaining solution must be discarded in a safe and sanitary manner after use on a customer.
