§ 31.01 CITY ADMINISTRATOR.
   (A)   There is hereby established the position of City Administrator.

   (B)   The duties of the City Administrator shall include those duties prescribed by law for statutory city clerks and treasurers. The Administrator may employ the title of clerk, treasurer, administrator or hyphenated combinations of these titles as deemed necessary or convenient.

   (C)   (1)   The City Administrator shall be the chief administrative officer of the city and shall be responsible to the Council for the proper administration of the duties set forth in this section and all affairs of the city.
      (2)   The City Administrator shall supervise the administration of all departments and offices of the city, including but not limited to police, public works, utilities, fire and liquor store, and may delegate duties and responsibilities to city department supervisors.
      (3)   The City Administrator shall develop and issue all administrative rules, regulations and procedures necessary to insure the proper functioning of all departments and offices of the city consistent with federal and state laws and city ordinances, including but not limited to department practices or procedures, and performance of department responsibilities. The rules, regulations and procedures shall be effective upon issuance and shall continue to be in effect until rescinded by the City Administrator or by the express action of the Council.
      (4)   (a)   The City Administrator shall be the personnel officer of the city with the following duties:
            1.   Implementation of all adopted personnel policies;
            2.   Periodic evaluation of all city employees; and
            3.   The negotiation of the terms and conditions of employee compensation for presentation to the Council.
         (b)   The City Administrator may delegate these responsibilities.
      (5)   The City Administrator shall develop and issue all administrative rules, regulations and procedures necessary for effective personnel management consistent with federal and state laws and city ordinances, including but not limited to:
         (a)   Scheduling of work, including overtime;
         (b)   Payroll practices, including determination of work periods and payroll check issuance;
         (c)   Hiring, discipline and termination practices;
         (d)   Grievance resolution; and
         (e)   Compensation negotiations.
      (6)   The City Administrator, or respective department heads as delegated by the City Administrator, shall interview and screen prospective city employees as permitted by law and shall make recommendations to the Council before the Council makes any appointment. The City Administrator shall have the power, as provided in the city personnel policy, to discipline or to discharge with the approval of the Council any city employee.
      (7)   The City Administrator shall prepare and submit a proposed annual budget to the Council and keep the Council advised of the financial condition of the city and make recommendations as may from time to time be determined desirable and/or necessary.
      (8)   The City Administrator attend and participate in discussions at all meetings of the Council and other official bodies as directed by the Council.
      (9)   The City Administrator shall monitor all consultant and contract work performed for the city. The City Administrator shall coordinate the activities of the city attorneys.
      (10)   The City Administrator shall recommend from time to time the adoption of measures as the Administrator deems necessary or expedient for the health, safety and welfare of the community or for the improvement of the administration.

   (D)   The City Administrator shall have the same general qualifications for municipal service as other city employees pursuant to the city personnel policy. Appointment shall be made by the Council solely on the basis of executive, administrative, educational and experiential qualifications. Unless expressly indicated otherwise by this section, the Administrator shall be subject to the city personnel policy.
