§ 30.31 DUTIES AND POWERS OF THE MAYOR.
   (A)   Generally. The recitals contained in the preamble of Ord. 0318-2 are determined to be true and correct and are hereby adopted as a part of this section.
   (B)   Specified powers of the Mayor. The city hereby adopts an enumeration of specific powers that may be exercised by the Mayor.
      (1)   The Mayor is the presiding officer of the City Council meetings, and, except in elections, may only vote in the event of a tie vote.
      (2)   The Mayor is the Chief Executive Officer of the city. The Mayor shall actively ensure that the laws and ordinances of the city are enforced. The Mayor must also perform all duties prescribed by the City Council.
      (3)   The Mayor has the express powers to declare a local state of disaster and as the Emergency Management Director for the city has statutory powers and duties during an emergency.
      (4)   The Mayor is empowered to inspect the conduct of the officers and employees of the city. This power does not include the power to hire and fire without the approval of the City Council.
      (5)   The Mayor may administer oaths of office (i.e., swearing in ceremonies).
      (6)   The Mayor may sign contracts, deeds, easements, bonds and other documents as directed or authorized by the City Council.
      (7)   The Mayor may call a special Council meeting, at the Mayor’s discretion, or a special meeting may be called at the request of two Council members.
      (8)   The City Council may confer additional powers and duties on the Mayor in addition to those provided by state law.
   (C)   Express limitations on the powers of the Mayor. The following are an enumeration of specific limitations on powers that may be exercised by the Mayor.
      (1)   The Mayor with requisite approval of the City Council may make appointments to certain vacant offices of the city, other than vacancies on the City Council, and in accordance with state law.
      (2)   The Mayor may not take adverse actions against officers or employees of the city or against public service providers hired by the city without the express written consent and a super majority (i.e., a four-fifths vote) of the City Council.
      (3)   All policy initiatives may not be implemented without the express, written consent of the City Council.
      (4)   Any rule or regulation initiated by the Mayor must first by approved by the City Council.
      (5)   All complaints presented to the city should be processed by the Mayor. If a complaint involves city staff or a public service provider, the complaint must be presented to the City Council.
      (6)    Membership on any committee, sub-committee, board, or commission that will transact business for or on behalf of the city shall be appointed by the and confirmed by the City Council. Membership on any committee, sub-committee, board, or commission must be approved by a vote by the City Council.
