(A) The city has contracted with several water customers who are located outside the city limits. When drought conditions trigger Stage 1 criteria, each outside city water customer will be mailed or faxed a notice requesting that they comply with the same voluntary water use practices as the water customers of the city.
(B) When moderate or Stage 2 criteria are triggered, each outside city water user will be mailed or faxed a letter advising that they will be expected to comply with a pro-rata reduction of water usage in compliance with provisions of the Tex. Water Code, § 11.039. This pro-rata reduction shall mean that the same water use restrictions enforced on the city water users will be applicable to outside city water customers.
(C) If Stage 3 criteria are triggered the city will mail or fax a letter to each outside city water customer advising that each outside city water customer will be expected to comply with the same restrictions as customers of the city and each outside city water customer must comply with the provisions of the Tex. Water Code, § 11.039.
(D) If, however, a customer does not receive a notice sent by the city, it shall be the outside city customer’s responsibility to contact the city to determine the restrictions with which it must comply. In future contracts for outside city water sales or renewals of existing contracts the city will include a provision stating that in case of a shortage of water resulting from a drought or equipment failure, the water to be distributed shall be divided in accordance with the Tex. Water Code, § 11.039.
