§ 96.40 PERMIT REQUIRED; APPLICATIONS.
   (A)   It shall be unlawful for any person, firm or corporation to tunnel under or to make any excavation in any public street, roadway or other public place without first having obtained a permit from the office of the village clerk.
   (B)   An application for permit required under the terms of this chapter shall be made to the village clerk and shall describe the location of the intended excavation or tunnel, the size thereof, the purpose therefor and the person, firm or corporation doing the actual work, along with the name of the person, firm or corporation for whom the work is being done. The application shall contain a covenant on the part of the applicant that the applicant will comply with all ordinances and laws relating to the work to be done in the village.
