§ 90.17 RESTRICTION ON NUMBER OF DOGS OR CATS.
   (A)   Maximum Number Allowed: No more than 3 dogs or 3 cats or combination thereof shall be allowed in any residence or apartment in the village.
   (B)   Exceptions:
      (1)   The owner of a residence or person occupying an apartment who has a dog or cat exceeding the permissible number set forth in division (A) above may retain the puppies or kittens born of the dog or cat for 12 weeks after the birth of the animals.
      (2)   Any owner of a residence or person occupying an apartment who has lawfully owned more than 3 dogs or 3 cats or combination thereof prior to the enactment of this ordinance may retain their animals, provided that:
         (a)   The animals in the residence or apartment are not creating a nuisance.
         (b)   There is adequate waste disposal.
         (c)   There is no hazard to public safety, health and welfare. If for any reason an animal is lost, sold, given away or dies and 3 or more dogs or 3 or more cats or combination thereof remain in the residence or apartment, there can be no replacement of the lost, sold or deceased animal.
