ORDINANCE NO. 23-10-2276
AN ORDINANCE AMENDING THE LIQUOR LICENSE REGULATIONS OF THE VILLAGE CODE TO CREATE A NEW SPECIAL EVENT LIQUOR LICENSE CLASSIFICATION
WHEREAS, pursuant to its authority under the Illinois Liquor Control statute, 235 ILCS 5/1-1 et seq., the Village desires to amend the Village Code to create a new special event liquor license classification, as set forth in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lindenhurst, Lake County, Illinois, as follows:
Section 1. Recitals. The recitals are incorporated into this Ordinance by reference.
Section 2. Amendment to Section 111.19. Section 111.19, entitled “License Classifications and Fees,” of the Lindenhurst Village Code is amended to add the following new Class H license classification at the end of Section 111.19, as follows:
Class H: A class H special event license shall authorize the consumption or service of alcoholic liquor at a one-day special event offered by an existing retail or service establishment that would not otherwise qualify for a liquor license. A class H license application must be filed with the village clerk at least five (5) days prior to the special event. A class H license is a temporary license issued only for the event specified in the application and is valid only for the date, time, and location approved in the license. At the discretion of the liquor commissioner, class H licenses may be issued for multiple special public events, provided, however, that no more than one class H license may be issued to any one establishment within a six month period. The per day fee for each such temporary license shall be in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code.”

1. A Class G license is annually available and shall be issued for use at Lindenfest, the annual Village festival. The issuance of additional Class G licenses shall be made at the discretion of the Liquor Commissioner.”
Section 4. Amendment to Section 12.02. Section 2, entitled Liquor License Fees,” of Section 12.02, entitled “Comprehensive Fee Schedule,” of the Lindenhurst Village Code is amended to add the following new fee to that section of the chart:

Section 5.
Conflict
. All Ordinances and parts of Ordinances in conflict with this Ordinance are hereby repealed.
Section 6.
Effective Date
. This Ordinance shall be in full force and effect following its passage and approval as required by law.
