§ 112.36   SYSTEM EXTENSION TO SUBSCRIBERS.
   (A)   The grantee shall extend its system to all areas of the village in which a minimum density of 50 homes per miles exists. The grantee shall also provide service to those areas through which its trunk or distribution cable passes (for transportation purposes) even though the density may be less than 50 homes per mile.
   (B)   The minimum density of 50 homes per mile is identified as the minimum number of homes per mile which is financially viable for construction of cable television plant (aerial or underground) without placing undue burdens on subscribers through subscriber rates.
   (C)   The grantee shall, whenever it shall receive request for service from at least five subscribers within 600 feet from its existing system, extend the system to those subscribers at no cost to the subscriber for system extension other than usual connect fees for all subscribers. The 600 feet shall be measured in extension length of grantee's cable required for service located within the public way or easements and shall not include length of the necessary service drop to the subscriber's home or premises. In addition, the Safety-Service Director may on complaint from any potential subscriber residing in the village order the extension of the system to such subscriber after opportunity for hearing and notice to the grantee. In such cases, the Director in his or her discretion may order such extension to any such subscriber only on a reasonable contribution from the subscriber to the cost of such extension.
