§ 113.25 SECONDARY METALS RECYCLERS.
   (A)   Secondary metals recyclers shall keep the receipts and the records required by G.S. §§ 66-421 and 66-422 in an electronic format, and shall transfer such receipts and records electronically directly to the County Sheriff’s Office in a manner authorized by the Sheriff’s Office.
      (1)   In order to properly monitor all receipts for the purchase of regulated metals, the County Sheriff’s Office may require that all secondary metal recyclers implement the use of the online database system used by the Sheriff’s Office at the time that records are required to be provided. If the Sheriff’s Office changes the online database system it uses, then it will notify all secondary metal recyclers in its system of the change. The Sheriff’s Office shall allow for a reasonable transition period for all secondary metal recyclers to implement the use of the new database.
      (2)   All receipts for purchases shall be uploaded to the online database system by the secondary metal recycler within three business days of the purchase. Furthermore, all entries must include all identifying information of the individual delivering the regulated metals, as well as any and all identifying information of the purchased regulated metals pursuant to G.S, § 66-421.
   (B)   Violations. Pursuant to G.S. § 66-429, the following violations shall apply to this section:
      (1)   Unless the conduct is covered by some other provision of law providing greater punishment, any person knowingly and willfully violating any of the provisions of this section shall be guilty of a Class 1 misdemeanor for a first offense. A second or subsequent violation of this section is a Class 1 felony.
      (2)   Revocation of permits. If the owner or the employees of a fixed site are convicted of an aggregate of three or more violations of this section within a ten year period, the permit associated with that fixed site shall be immediately revoked by the Sheriff for a period of six months. Any attempt to circumvent this section by procuring a permit through a family member shall result in extension of the revocation period for an additional 18 months.
