§ 52.36 PRETREATMENT OF INCOMPATIBLE POLLUTANTS BY INDUSTRIAL USERS.
   In addition to the requirements set forth in § 52.35 of this subchapter, which section applies to all users, including industrial users, all industrial users are further required to meet the pretreatment requirements’ Best Practicable Control Technology Currently Available (BPT) if they are discharging incompatible or toxic pollutants, as defined by the applicable federal pretreatment regulations. The district or other authorized agent of the district shall be allowed to enforce upon industrial users any and all pretreatment requirements necessary to ensure compliance by the district with the terms and conditions of its NPDES permit, as well as to ensure compliance by all industrial users with the pretreatment standards and any other applicable requirements promulgated pursuant to the Federal Water Pollution Control Act, or other federal laws and regulations.
