§ 150.009 NATIONAL ELECTRICAL CODE, 2023 EDITION.
   (A)   (1)   Pursuant to C.R.S. §§ 31-16-201 et seq. as amended, there is hereby adopted as the Electrical Code of the town, by reference thereto, the National Electrical Code, 2023 edition, published by the National Fire Protection Association, One Batterymarch Park, Quincy, Massachusetts, 02269, to have the same force and effect as if set forth herein in every particular.
      (2)   The purpose of this code is for the practical safeguarding of persons and property from hazards arising from the use of electricity. This code contains provisions that are considered necessary for safety. Compliance therewith and proper maintenance results in an installation that is essentially free from hazard, but not necessarily efficient, convenient or adequate for good service or future expansion of electrical use in the town.

   (B)   The following section as contained in the National Electrical Code, 2023 edition, is hereby amended and herewith set forth in full and adopted, as follows:
Section 90.4. Enforcement. This Code is intended to be suitable for mandatory application by governmental bodies that exercise legal jurisdiction over electrical installations and for use by insurance inspectors. The Authority having jurisdiction for the enforcement of this Code shall be the Colorado State Electrical Board pursuant to C.R.S. 12- 115-107. The authority having jurisdiction for enforcement of the code will have the responsibility for making interpretations of the rules, for deciding on the approval of equipment and materials, and for granting special permission contemplated in a number of the rules.
The authority having jurisdiction may waive specific requirements in this Code or permit alternate methods where it is assured that equivalent objectives can be achieved by establishing and maintaining effective safety.
This Code may require new products, constructions, or materials that may not yet be available at the time the Code is adopted. In such event, the authority having jurisdiction may permit the use of the products, constructions, or materials that comply with the most recent previous edition of this Code adopted by the jurisdiction.
