§ 111.002 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly requires a different meaning.
   ELECTRONIC DELIVERY DEVICE. An electronic device that, when activated, emits a vapor or aerosol that may be inhaled or absorbed by the user, including, but not limited to, an e-cigarette, e-cigar, e-pipe, vape pen or e-hookah. ELECTRONIC DELIVERY DEVICE includes any component, part or accessory of such device, whether or not sold separately, and includes any substance, with or without nicotine, intended to be aerosolized or vaporized during use of the device.
   MINOR. Any person under 18 years of age.
   SMOKING. Holding or carrying of a lighted pipe, lighted cigar, lighted cigarette of any kind and includes the lighting of a pipe, cigar or cigarette of any kind.
   TOBACCO PRODUCT.
      (1)   (a)   Any product containing, made or derived from tobacco or nicotine that is intended for human consumption, whether smoked, heated, chewed, absorbed, dissolved, inhaled, snorted, sniffed or ingested by any other means, including, but not limited to, cigarettes, cigars, little cigars, chewing tobacco, pipe tobacco, snuff; and
         (b)   Any electronic delivery device that can be used to deliver nicotine or any other substance to the person inhaling from the device, including, but not limited to, an electronic cigarette, pipe, hookah or vaping device.
      (2)   Notwithstanding any provision of divisions (1)(a) and (1)(b) above to the contrary, TOBACCO PRODUCT includes any component, part or accessory of a tobacco product, whether or not sold separately.
      (3)   TOBACCO PRODUCT does not include any product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product or for other therapeutic purposes where such product is marketed and sold solely for such an approved purpose.
