(A) It shall be unlawful for any person to dispose of wastes at the disposal facilities of the town where such wastes have been collected and/or held in a tank or other container and where such wastes fail to comply with any limitation set out in § 53.052 of this chapter.
(B) The town shall endeavor to identify and compile a record of those sources which produce or may produce wastes which are or may be in violation of the limitations imposed by this section and any such record shall be available to any person as the town’s open records policy provides. However, the limitations imposed by this section shall apply without regard to the existence, substance or availability of any such record.
