870.02   NON-DISCRIMINATION IN EMPLOYMENT WITHIN THE CITY.
   Except as may be permitted by law because of a bon-fide physical, medical, skill, knowledge, experience, or education qualification or because of a bona-fide employment policy, rule, law, or court order involving civil rights or veterans preferences, no employer located within the City of Lima corporate limits shall discriminate against any person because of such person's race, color, religion, sex, gender, gender identity or expression, sexual orientation, military status, national origin, disability, age, or ancestry.
   (a)   Exemptions from Provisions. Exempt from the requirements of this section shall be:
      (1)   Any employer of less than four persons. Members of the immediate family of an employer shall not be included in determining the number of employees;
      (2)   A religious corporation, association, educational institution, or society with respect to the employment of an individual of a particular religion to perform work connected with the carrying on by that religious corporation, association, educational institution, or society of its activities.
   (b)   Nothing in this section shall be construed to require the modification of existing facilities or the construction of new or additional facilities.
