A person who causes or maintains a property found to be a public nuisance, pursuant to and in violation of this Code, or fails to comply with an order to abate issued by the Public Nuisance Administrator, upon conviction thereof, shall be subject to the following penalties;
(a) For a first conviction, a misdemeanor of the fourth degree, and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty days, or both.
(b) For a second conviction, a misdemeanor of the third degree, and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both.
(c) For a third conviction, a misdemeanor of the second degree, and shall be fined not more than seven hundred fifty dollars ($750.00) or imprisoned not more than ninety days, or both.
(d) For a fourth or subsequent conviction, a misdemeanor of the first degree, and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both.
