2002.08   PUBLIC NUISANCE DEFINED.
   For purposes of this Code a finding of at least one of the following conditions supports the conclusion that the building, structure, parcel of real property, premises, or portion thereof, constitutes a hazard to the public, health, morals, safety, and welfare of the inhabitants of the City;
   (A)   Any building, structure, or portion thereof, has become so dilapidated or deteriorated, by failure to repair and maintain or by fire or weather damage, as to become and attractive nuisance to children, a harbor for vagrants, criminals, or as to enable persons to resort thereto for the purpose of committing unlawful or immoral acts; or
   (B)   Any premises that is manifestly capable of being a fire hazard or that is in such a condition to be dangerous to anyone at or near the premises; or
   (C)   Any building or structure that is open, vacant or abandoned, that is overcrowded, that is damaged by fire to such an extent that it does not provide shelter or that is danger of collapse or failure, or is manifestly unsafe or unsecured so as to endanger life, limb or property; or
   (D)   Any building or structure, used or intended to be used as for dwelling purposes, because of inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air or sanitation facilities or otherwise, is determined to be unsanitary, unfit for habitation, or in such a condition that is likely to cause sickness and disease;
   (E)   Any premises from which plumbing, heating or other facilities may be required have been removed, or from which utilities have been disconnected, destroyed, removed, or rendered ineffective, or from which the required precautions against trespassers has not been provided;
   (F)   Any premises that is subject to notice or order of property maintenance violations, as provided in Chapter 18 of the Lima Codified Ordinances; building code adjudication order, notice of violation, cease and desist order, or demolition order, as provided in Chapter 14 of the Lima Codified Ordinances; and/or adjudication order, notice of violation, or cease and desist order as provided in Chapter 12 of the Lima Codified Ordinances; or,
   (G)   Any premises wherein there is present noxious or offensive odors or noise, repeated breaches to the peace of the neighborhood, loitering, or unsanitary conditions which are a menace to the health, comfort, or safety of the community. The source of such odors, noise, breaches of peace, or unsanitary conditions may be derived from the conduct of persons and/or the harboring or keeping of animals or foul;
   (H)   Any premises that is unsafe and unsanitary, or that is littered with rubbish, offal, garbage, contains sewage, stagnant water, or that has an uncontrolled growth of weeds, grass or other vegetation so as to interfere with the reasonable and lawful use and enjoyment of premises within the neighborhood; or
   (I)   Any building, structure, premises or portion thereof, is in such condition as to constitute a public nuisance by common law or as otherwise defined by statute, regulation, or codified ordinance as a public nuisance.
