(a) For purposes of this section a “bonfire” is an open burning fire that is used for cooking food for human consumption, pleasure, religious, ceremonial, warmth, recreational or similar purposes that is fueled by clean seasoned firewood or its equivalent, is not used for waste disposal, and has a total fuel area greater than three feet in diameter or two feet in height and no more than five feet in height and five feet in width; and,
(b) No person shall cause a bonfire and/or ceremonial fire to be conducted in a manner prohibited by the Ohio Fire Code, as adopted in this chapter, the Ohio Administrative Code and any rules and regulations of the EPA or Ohio EPA; and,
(c) Any person who causes a bonfire to be conducted shall, ten days prior thereto, notify the Ohio EPA, as required by Rule 1301:7-7-01 of the Administrative Code, and apply for a permit through the Lima Fire Department Fire Prevention Bureau; and,
(d) Whoever violates division (c) of this section by failing to obtain a permit from the Fire Prevention Bureau is guilty of a minor misdemeanor.
