1040.291 APPEALABLE MATTERS.

   (a)   Except for those matters set forth in subsection (b) hereof, a user adversely affected by a decision or order of the Director under this chapter shall have the right to appeal from such decision or order to the Board of Appeals.

   (b)   The Board of Appeals shall not have jurisdiction over:

      (1)   Decisions or orders of the Director which relate to technical matters affecting the operation of the treatment works;

      (2)   Decisions or orders mandated by the provisions of the City's NPDES permit; or

      (3)   Decisions or orders involving the provisions of Sections 1040.12, 1040.13, 1040.141, 1040.143 and 1040.99.
