882.04   ADMINISTRATION; STANDARDS FOR PARTICIPATION.
   (A)   The application process for the Lima New Jobs Program shall be administered by the Director of Taxation, subject to the authority of the Mayor to enter into contracts for the payment of the incentives.
   (B)   Interested owners, developers or businesses shall submit an application seeking to participate in the program and obtain approval as a Qualified Owner or Qualified Business or Qualified Developer before the New Jobs are created within the City or the Central Business District, unless otherwise authorized by the Mayor.
   (C)   The application must contain a forecast of the number of New Jobs to be created, the new payroll associated with those new jobs, a description of any new investment associated with those new jobs, and any other relevant information requested by the Taxation Director.
   (D)   Qualified Owners, Qualified Developers, and Qualified Businesses shall provide annual documentation of their performance under the Lima New Jobs Program, containing such information as determined necessary by Taxation Director.
   (E)   The Director of Taxation may promulgate such rules and regulations as he determines are necessary to effectuate the intent of this Chapter, and that are not directly contrary with any of the provisions in this Chapter. The failure of an applicant to abide by a non-substantive procedural requirement of this Chapter may not necessarily invalidate the application, as determined in the discretion of the Mayor. Such rules and regulations shall be kept on file in the taxation office.
   (F)   Documents or information submitted by an owner, developer, or business to the Director of Taxation for purposes of this Chapter shall be deemed to be a trade secret and/or confidential information as set forth in Section 880.09(d) of the Codified Ordinances of the City of Lima.
