864.03   EXCEPTIONS.
   (A)    If a home sale is not held on the dates for which the license is issued or is terminated during the first day of the sale because of inclement weather and an affidavit of the license holder to this effect is submitted to the License and Permits Division, the Division may issue another license for another home sale to be conducted at the same location within thirty days from the date when the first sale was to be held. No additional permit fee shall be required.
   (B)   This chapter shall not be construed to prohibit the sale or to require a license for the sale of personally pursuant to an order or process of a court of competent jurisdiction, the sale of personally by a licensed auctioneer, the sale of personally by public officers and officials acting in accordance with their authority, or the sale by any bona fide charitable, religious, or educational institution or organization when the proceeds from the sale are used directly for the institution or organization's charitable purposes and the personally is not sold on a consignment basis.
