§ 440.15 ENGINE BREAKING PROHIBITED.
   (a)   Engine breaking is defined herein as use of the engine, by compression, to stop or slow a vehicle.
   (b)   No person shall utilize engine brakes (a practice commonly known as “jake braking”) when operating a commercial motor vehicle upon a street or highway within the municipality.
   (c)   The Public Works Director is hereby authorized to post the appropriate signs consistent with the provisions of this section.
   (d)   Public Safety vehicles are exempted from this provision.
   (e)   Whoever violates this section is guilty of an unclassified misdemeanor offense and shall be fined $100 for a first offense, $250 for a second offense within two years of the first offense, and $500 for a third or subsequent offense within two years of the first offense. No part of any such fine shall be suspended or otherwise reduced.
