§ 51.16  CONNECTION OF PROPERTY TO SEWER AND WATER LINES REQUIRED; TAPPING FEE.
   (A)   Every person who owns within the town a house, mobile home or other structure used or intended for human habitation or occupancy shall be required to pay the proper tapping fee as contained in the current town schedule of fees and connect his or her property to the town’s sewer line; provided that the town may make exceptions to this section in appropriate cases. In the event that an exception is made, at such time as the town determines that the property owner should pay the above mentioned tap fee and connect to the town’s wastewater system, connection to the town’s system shall be made within 30 days of notice to the property owner, and the tap fee paid within 90 days of notice to the property owner. This section shall apply to persons annexed as of the effective date of annexation. This section shall not apply to persons whose property is connected to the county wastewater system.

   (C)   In the event the owner of any property with tapping fees due sells the property, the new owner of such property shall be required to either pay the unpaid portion of the water and sewer tapping fee or shall sign a written assumption of the payment of the balance of such water and sewer tapping fee in the same manner as hereinabove outlined in divisions (A) and (B). This section shall be recorded in the Office of the Register of Deeds of the county to provide notice to any purchaser that such water and sewer tapping fees are a charge against the real estate.
   (D)   Sewer and water service requirements for residential property.
      (1)   Single-family home. One water meter with tap and system development fee. One sewer tap and system development fee. One base rate charged monthly.
      (2)   Duplexes. Two water meters with one tap and two system development fees. One sewer tap and two system development fees. One base rate charged monthly for each unit.
      (3)   Apartments and condominiums (three or more residential units in one building). Each residential unit within the building will require its own water meter with tap and system development fee. The number and size of sewer taps will be determined by the number of residential units that can be served according to the National Standard Plumbing Code. All residential units will require a sewer system development fee. One base rate charged monthly to each unit.
      (4)   Separate apartment units existing as of January 1, 2003 for which water and sewer are serviced dependently through the residential home will not be charged a monthly base rate for that apartment.
   (E)   Sewer and water service requirements for commercial property.
      (1)   Single-use office building (one building, one business). One water meter with tap and system development fee. One sewer tap and system development fee. One base rate charged monthly.
      (2)   Multiple-use office building (one building, more than one business renting office space). One water meter with tap and system development fee. One sewer tap and system development fee. One base rate charged monthly.
      (3)   Shopping center (two or more business units planned and constructed to occupy distinctly different space within one building). Each individual business unit within the building will require its own water meter with tap and system development fee. The number and size of sewer taps will be determined by the number of business units that can be served according to the National Standard Plumbing Code. All individual business units will require a sewer system development fee. One base rate charged monthly for each unit.
   (F)   Sewer and water service requirements for industrial property.
      (1)   Single-use industrial building(s) (one or more buildings, one industry). One or more water meters or compound meters with taps and system development fees. One or more sewer taps and system development fees. One or more base rates charged monthly.
      (2)   Multiple-use industrial building (one building, more than one industry renting space). One water meter or compound meter with tap and system development fee. The number and size of sewer taps will be determined by the number of units that can be served according to the National Standard Plumbing Code. All individual industrial units will require a sewer system development fee. One base rate charged monthly.
