§ 31.031  DUTIES AND POWERS.
   (A)   The Manager shall be the Chief Administrator of the town. At the first meeting of the Town Board following each general election of Commissioners, such Board shall appoint a Town Manager to serve at the will and pleasure of the Board.
   (B)   He or she shall be responsible to the Town Board for administering all municipal affairs placed in his or her charge by it and shall have the following powers and duties:
      (1)   He or she shall appoint and suspend or remove all town employees not elected by the people and whose appointment or removal is not otherwise provided for by law except the Town Attorney, in accordance with such general personnel rules, regulations, policies or ordinances as the Town Board may adopt;
      (2)   He or she shall direct and supervise the administration of all departments, offices and agencies of the town subject to the general direction and control of the Town Board except as otherwise provided by law;
      (3)   He or she shall keep the Town Board currently informed as to the condition of town affairs and may make such recommendations from time to time as he or she considers desirable for the good of the town. At the first meeting of the Board each month, he or she shall present to the Board an account of the transactions of his or her office involving the collection or expenditure of any money of the town;
      (4)   He or she shall attend all meetings of the Town Board and recommend any measures that he or she deems expedient;
      (5)   He or she shall see that all laws of the state, the Town Charter and the ordinances, resolutions and regulations of the Town Board are faithfully executed within the town;
      (6)   He or she shall prepare and submit the annual budget and capital program to the Town Board;
      (7)   He or she shall annually submit to the Town Board and make available to the public a complete report on the finances and administrative activities of the town as of the end of the fiscal year;
      (8)   He or she shall make any other reports that the Town Board may require concerning the operations of town departments, offices and agencies subject to his or her direction and control;
      (9)   Recommend to the Board revisions to the personnel ordinance, position classification and pay plan for its consideration;
      (10)   Determine administrative, professional and managerial positions to be excluded for entitlement to overtime compensation, as provided for;
      (11)   He or she shall serve as the Zoning Administrator;
      (12)   He or she shall serve as the Town Budget Officer; and
      (13)   He or she shall perform any other duties that may be required or authorized by the Town Board.
