§ 96.02  OVERHANGING AWNINGS, SIGNS AND THE LIKE.
   (A)   It shall be unlawful for any person to erect or repair over any street or sidewalk any wooden shed or awning, or any wooden frame for the support of any awning, or to erect upon any street or sidewalk any wooden post for the support thereof; provided, that this division (A) shall not be construed to prevent the erection over the sidewalk of cloth awnings upon metallic frames, securely suspended from buildings or supported by metallic standards; nor shall it be construed so as to prohibit the erection of upper piazzas or verandas over sidewalks at such points as the Board of Commissioners may grant the privilege of erection. Such piazzas or verandas are to be supported by such standards as the Board of Commissioners may designate in each instance.
   (B)   It shall be lawful to have cloth awnings on iron frames securely suspended from the building and extending across the sidewalks in front of stores, shops, business houses and the like; provided, that they are acceptable to the Board of Commissioner and that they are kept in neat and sightly condition and in good repair.
   (C)   It shall be unlawful for any person to have or permit any shelter, sign or other contrivance whatsoever over any sidewalk in the town; provided, that this shall not prevent signs extending to the utilities strip but not beyond such utilities strip and provided that such sign is placed at such height as not to interfere in any way with the use of the sidewalk.
   (D)   Any town police officer shall have authority to remove an obstruction which shall be suffered to remain on or over any sidewalk in violation of this section.
